Establishes the Legislature's statewide plan for higher education, which includes increasing capacity by 30,000 enrollments, awarding 3,000 additional baccalaureate degrees annually, adding 12,500 additional enrollments in high demand fields, and increasing the state's overall investment in higher education by $460 million per biennium.

Requires each higher education institution to adopt rules regarding disruptive off-campus conduct that apply while students are proximate to, but not on, campus. The rules must not violate students' civil rights and must provide due process. Institutions report on their rules by December 1, 2005.

The bill establishes renewable energy standards for state agencies. State agencies are directed to purchase a certain percentage of their total electricity from qualified alternative energy resources. The renewable energy standard is increased in phases: - By July 1, 2006, state agencies must buy at least five percent of their total electricity from qualified alternative energy resources. - By July 1, 2007, state agencies must buy at least ten percent of their total electricity from qualified alternative energy resources. - By July 1, 2008, state agencies must buy at least fifteen percent of their total electricity from qualified alternative energy resources. - By July 1, 2009, state agencies must buy at least twenty percent of their total electricity from qualified alternative energy resources.

The Washington technology center and Washington State University shall each establish a small business innovation research assistance program, including a proposal review process, to train and assist Washington small businesses to win phase I small business innovation research program awards.

The zero interest loan program is established for students attending a Washington institution of higher education. The first loans shall be made to eligible students enrolling in an institution of higher education in the 2006-07 academic year.

The legislature finds that the state of Washington has an affirmative duty to protect, manage, and conserve public natural resources such as the state's animal and plant life, and must take this public trust into account when making decisions with respect to natural resource-related policies and actions. Property rights in wild fish and animals are vested in the state for the benefit of all the people and the regulation of natural resources must be for the common good. The paramount interest of the public is retained by the state to protect the public's rights to natural resource use.

Beginning in the fall of 2006, Washington State University Tri-Cities may admit lower division students without the limitation of co-admission and coenrollment with Columbia Basin College. The campus will develop into a four-year institution of higher education by simultaneously admitting freshman and sophomores, increasing transfer enrollment, co-admitting transfer students and expanding graduate and professional programs.
Substitute Bill Compared to Original Bill: Washington State University Tri-Cities will continue to work with Columbia Basin College as outlined in the Columbia Basin College and Washington State University Tri-Cities Coordinated Bachelors agreement.

From funds appropriated specifically for this purpose, the Washington State University energy extension program shall provide consumer education and outreach regarding the use of biofuels in transportation, heating, electricity generation, and other applications. These services must be primarily implemented through grants allocated on a competitive basis to public agencies, nonprofit organizations, and business entities that propose education and outreach programs.

The state energy policy is amended to require state agencies to reduce their energy purchases by 15 percent (measured from fiscal year 2005) by September 1, 2009. Agencies are required to use all practicable, cost-effective means available, including energy efficiency programs and the use of on-site renewable resources. Annual reporting requirements to the Department of General Administration are established. Definitions of "state agency" and "energy" are made, which are consistent with the statutes concerning energy conservation projects.

The definition of "eligible national guard member" for the purposes of tuition waivers is changed to include current members of the National Guard. The requirement that the Guard member must have been called to active duty to be eligible for the tuition waiver is removed.

The Legislature finds that a priority on enrollments and degrees in the fields of engineering, technology, biotechnology, science, computer science, and mathematics is important to the state's economic future. Therefore, the Legislature intends to promote and place a priority on increased access, delivery models, enrollment slots, and degree opportunities in these fields.
Public institutions must determine local student demand and report findings to the HECB and the Legislature by November 1, 2008.

Summary of Substitute Bill: The Board of Regents of the state universities and the Board of Trustees of the regional universities and The Evergreen State College, in collaboration with the affiliated bookstores and a student and faculty representative, must adopt rules requiring affiliated bookstores to allow students the option of buying unbundled course materials when possible. The rules would also require the bookstores to disclose the actual cost of the materials and how new editions vary from previous editions. Additionally, the affiliated bookstores must actively promote and publicize book buy-back programs and will be required to disclose retail costs for course materials on a per course basis.
